UPDATE: DA's Office Investigating Romney Sandwich Bribe Complaint

The Democratic Party of Wisconsin said Tuesday it has filed a election bribery complaint with state election officials and the district attorney after GOP presidential frontrunner Mitt Romney and U.S. Rep. Paul Ryan handed out free Cousins Subs.

 

Update 4:30 p.m. Wednesday with comment from district attorney

The Waukesha County District Attorney’s office has launched an investigation into allegations that GOP presidential candidate Mitt Romney and Congressman Paul Ryan traded sub sandwiches for votes in Waukesha on Election Day.

"We now have the complaint and, yes, we have commenced the investigation," District Attorney Brad Schimel told Patch in an email Wednesday.

Schimel, who is out of the office until April 16 added: "I hope that a resolution can wait until I am back, but I am in regular communication with the investigator."

The Democratic Party of Wisconsin filed the complaint in Waukesha Wednesday morning.

Detective David Witkowski of the Waukesha County Sheriff’s Department, who is assigned to the district attorney’s office, said he is investigating the complaint. Witkowski was at the Cousins Subs in question Wednesday morning and is waiting for a few phone calls to be returned.

“I don’t have a lot of information at this point,” Witkowski said.

Party Chairman Mike Tate said at a press conference Tuesday that Democrats have filed a complaint with the Government Accountability Board, the state agency that oversees elections in Wisconsin, and with the district attorney's office.

Video captured by Patch shows Romney and Ryan handing out the sub sandwiches. Additionally, a video edited by the state Democratic Party shows Romney leading a rally and telling supporters to go vote, and “If you want another sandwich, there are more back there.”

State law prohibits offering something valued at more than $1 in exchange for a vote.

Tate said it’s a clear-cut case of election bribery.

“We have pretty clear video evidence of Mitt Romney and Congressman Ryan handing out free sandwiches, and at the same time encouraging people to go cast a ballot,” Tate said. “It’s very clearly against Wisconsin election law.”

Reid Magney, a spokesman for the GAB, told Patch that his agency had received the complaint, but would not be investigating the incident because it is a criminal matter. It will be up to the district attorney to decide what action — if any — should be taken.

Even though the GAB is not investigating the incident, Magney said the agency routinely tells campaigns not to give away anything of value to voters.

"We advise candidates and businesses not to provide food, beverages or any other inducement to thank people for voting or to get them to vote," Magney said.

It doesn't matter whether a candidate gives away something as part of a general "get out the vote" effort, or if a candidate is trying to entice someone to vote a certain way, he added.

"We believe voters should vote because they care about the candidate or the process," Magney said. "Not because they got a free sandwich or a free beer."

However, Romney told WISN12 news the allegations are ridiculous and it’s a laughable stunt by the Democrats to distract from President Obama’s policies that have resulted in “record job losses and skyrocketing gas prices.”

Tate is calling for an investigation by election officials and criminal sanctions to be imposed.

The incident brought back memories of the infamous "smokes for votes" allegations in the 2000 presidential election, in which Democrats were accused of giving homeless people cigarettes if they cast ballots for presidential candidate Al Gore.

"Republicans like Scott Walker were vocal about the so-called 'cigs-for-sigs' situation in 2000, and 'Kringle-gate' in 2002, not to mention repeated calls for the rule of law to be applied to the fullest extent in the almost nonexistent instances of voter fraud," said Graeme Zielinski, spokesman for the Democratic Party. "Here is a case that's much, much stronger-the candidates themselves are participating in the bribery.

"The statute is clear. So were the actions of Mitt Romney and Paul Ryan," he added. "I don't think a prosecutor, regardless of his party affiliation, has any choice but to act and apply the laws of the State of Wisconsin."

This is one time where I must unfortunately side with Mike Tate.

Honestly - what were Ryan and Romney thinking???

Coming off the 'Smokes for Votes,' 'Cigs for Sigs,' and 'BBQ for Votes' scandals, I just can't fathom the logic of whoever thought that this would be a good idea!

They should have known better. Even if technically distinguishable from those other scandals, it still doesn't look very good.

Epic fail by Ryan and Romney on this one!

Paul, although I forgive you for your lapse of judgment, you really let Hoffa down on this one. Next time, do your homework before getting anymore bright GOTV ideas!

I didn't see either politican say, "Vote for Mitt Romney, get a free sandwich". They only said, "vote, here is a free sandwich". It makes a HUGE difference, and under these circumstances, Romney is innocent of of these ridiculous allegations.

I am not a Romney supporter at all, (Ron Paul!!), but lets be sensible here, Romney didn't really commit any crimes, he was just being a nice guy and trying to get people to cast a vote of some kind.

IMHO, this should be dropped before it gets out of control.

I love us good ol' Americans. We seem to be ignorant enough to think that this could actually happen. Lets play out this scenario for a second, shall we. I guess Americans are dumb enough to base their vote not on what they believe or feel is correct, not on a political belief or even a religious belief. But you know what we will base our vote on??? Of course! That's it... A FREE SUB!!! All this time I thought we wanted candidates who could change this country for the better. Nope, we believe that giving out free food is the right way! It all makes sense now.
p.s. I could care less about Romney but buying votes with subs... if you believe that someone will forsake their political views for a sub then you are unrealistic and probably not to intelligent..

And, I believe, the sandwiches were donated by the Cousins Sub company... not bought by Ryan or Romney. If I had known about this, I'm sure I would have gone to get a free sub... wouldn't you?

Jim, I read the story a bit differently. As I read it all Romney said was go vote. There was no mention of them getting a sandwich to vote for him. All he said was go vote. To me he is saying exercise your right as an American and do the American thing by voting. I cannot see that this is a big deal but rather an attempt by the Wisconsin Democratic party to muddy the waters. Obama seems to be falling in the polls so I think the 'party' is getting a bit desperate. But then, this is my opinion only. Not sure if I am right or wrong, just an opinion.

Usually that only happens when HuffPo cross promotions are involved. So either something else is going on here, or there is something on HuffPo that we just haven't found yet. I also find it hard to believe that all the right-wing comments from new names would be coming from CA! Then again, they did elect Schwarzenegger and I guess the northern part of the state is fairly conservative.

I concur that this was indeed a major gaffe by Romney/Ryan - what were they thinking??? The legal questions arising from such situation are who held legal title to the sandwiches when given away by the duo, and whether or not such was done to induce the act of getting electors to the polls, otherwise, everything else is pretty open and shut, as seen on the video of the incident.

Because Romney is a national candidate though, the penalties for a violation of the election bribery law, although a Class I felony, aren't as severe as they would be for Ryan. The mens rea, or criminal intent, behind committing such an offense also poses a substantial burden of proof in any criminal prosecution under such statute.

Interesting enough, under the standard expressed in the opinion letter issued by the Milwaukee County DA's office in the 'BBQ for Votes' incident, the facts of this situation would NOT warrant an official charge being issued, as voting was not a requirement for obtaining the free sub. However, Hoffa personally believes that the Milwaukee County DA's opinion was in error, ignoring the clear intent of the statutory language.

No matter - it was still a STUPID thing to do!

Here's the official statutory section that Romney/Ryan are accused of violating:

12.11 Election bribery. (1) In this section, “anything of
value” includes any amount of money, or any object which has
utility independent of any political message it contains and the
value of which exceeds $1. The prohibitions of this section apply
to the distribution of material printed at public expense and available
for free distribution if such materials are accompanied by a
political message.
(1m) Any person who does any of the following violates this
chapter:
(a) Offers, gives, lends or promises to give or lend, or endeavors
to procure, anything of value, or any office or employment or
any privilege or immunity to, or for, any elector, or to or for any
other person, in order to induce any elector to:
1. Go to or refrain from going to the polls.
2. Vote or refrain from voting.
3. Vote or refrain from voting for or against a particular person.
4. Vote or refrain from voting for or against a particular referendum;
or on account of any elector having done any of the above.

As you can see, the law states that a mere inducement to get an elector to go to the polls and/or vote (without mention of who to vote for or against) is a violation under 12.11(1m)(a)(1) and/or (2).

However, 12.02 states that "[i]n this chapter, criminal intent shall be construed in accordance with s. 939.23," setting an extremely high mens rea bar to prosecution. In other words, the DA would have to prove beyond a reasonable doubt that in fact Romney/Ryan were intending to break the law at the time they engaged in such activity. One of the few instances where ignorance of the law could work as a valid legal defense, which would explain Ryan's public statement claiming ignorance in this situation.

The Milwaukee County DA has taken it one step further in an opinion letter issued on the earlier 'BBQ for Votes' incident that occurred during last year's senatorial recalls, stating that there must be conclusive evidence linking the act of giving the thing of value to the elector and the elector actually voting (a causation element). Personally, I think that the Milwaukee County DA was stretching here to suit a desired outcome/result against prosecution in that incident. Under such a standard, Romney/Ryan obviously did nothing wrong, as there is no direct causation between the act of giving and the act of voting. But one doesn't really need to make such a stretch of the statutory language due to the high bar set by the required showing of mens rea (criminal intent) to conclude against prosecution in this case.

Well, I think to try to say they were bribing voters with sandwiches, is a little benign. They told them to eat up and go vote. They did not specify they had to vote for them for the sandwiches. They would have given Obama one, if he had the guts to come see. It is all just a smoke screen to try to get people against the, What about the Unions with the DemonicRATs? Of the field, Huntsman was the most rational. He has experience in international matters, has functioned successfully in a bipartisan environment, and best of all, his eyes hold the gleam of intelligence. When I think of Huntsman on the international stage as compared to others in the field I don't feel the same prescient dread. (Except Newt. The dread I feel in his case is interstellar!)

I think it was a stupid decision to hand out the subs... someone should have thought about the political ramifications. However, that being said, the left has been doing that for years so them screaming foul is ironic. I know several have mentioned the "Smokes for Votes" and the "BBQ for Votes".... but also remember what started this whole recall joke was the paid and unpaid protesters in Madison being fed by organizations and people from all over the country calling in pizza orders to local pizza shops to drop off for the protesters. I personally don't see any difference between the two.

My mother and I went there last minute after I read about it hear on PATCH this morning, specifcally to have the opportumity to meet Mitt Romney. The free sandwich was an unexpected bonus, NOT a bribe to vote.

Mitt Romney plans to de-fund Planned Parenthood. I saw a Q&A where a woman asked him where low income women would get the tests, screenings, inoculations, etc., that is PP's primary purpose if PP went away. His answer was basically "anywhere, it's a free country." His female support base has dwindled as a result.

I think Mitt makes good decisions for himself, family, and former colleagues, not so sure he's out of that mindset.

-Relative with upcoming college grad will be able to keep offspring on insurance if needed until the age of 26 (relative pays 30% of employer-paid health insurance and 100% of student's premium-no cost to employer or taxpayers).

Relative with pre-existing condition cannot be turned down for coverage based on that condition. This saves taxpayers money by providing preventive and lower-tiered care instead of escalated expenses due to more severe health issues, as currently happens with most uninsured people who become ill.

Relative with Medicare D will not have to worry as much about the "donut hole." Privatized health care doesn't make good sense. Corporations exist to make profit. The results of a for-profit industry providing human services have come to fruition as expected: the industry finds ways to boost profits and the client base has little choice but to pay.

Recent statistics show that the vast majority of Americans, Democrat and Republican, support the components of "Obamacare" once explained. Who doesn't know someone in one of these situation?

While I still prefer a National Health Care Plan, I do believe that everyone should pay something toward their healthcare as they are able, even though most of it will be hoovered up as profit by the health insurance industry.

However, explain to me where it is fair for people who do not have an income, or a very low income, to be FORCED to pay for insurance, or be fined $1,000.00 Until they buy it? Ask the Canadians about National Health Care of any kind. Why do you thing they would rather come here to get treatment and pay for it themselves? First of all, the health care people and places here are charging way too much for their nonsense. An aspirin when I was in the hospital was $0.50.. Now it probably has doubled or tripled. Insurance people get rich by selling it, so what do you think is going to happen when we are FORCED to buy it? The price goes UP. It happened with Auto Insurance rates.

America has never been legal to FORCE anyone to buy anything. This is supposed to be a free land, and we are now running on a Dictatorial base. That is Communism.

Gee, I remember reading or hearing about the Iowa Straw Poll whereby it cost each voter $30 for the ballot, and that Bachman's camp bought hundreds of them and gave them out for free. Seems like a much bigger deal than a sandwich. Even though the Straw Poll is non-binding...it still probably influenced a lot of voters...which could have spilled over in to the caucuses, and perhaps the general election when it happens, if she was still running.

This is outrageous. How can Republicans call out Democrats on handing out actual cash for votes or giving out welfare checks for votes if they are going to turn around and hand out free sandwiches? I know the upper crust of the Democratic party are the elite rich, and have the money and our taxes to pay off the poor, but the Republicans better do a better job than this if they want to buy my vote. i think their intentions are to turn this country into Europe. I wish everyone would go to England and see socialized medicine, up close. I did. I took a course for medical professionals and spent two weeks their specifically, to learn about it. It was barbaric.

This does not surprise me. Remember that the current far right wing of the Republican Party, through "the architect," used the DOJ to prosecute only Democrats down South. A clearly obscene violation of all moral dictates. All Republicans involved were left alone. The blatant disregard for voting rights upheld by 5 Republican Justices who then gave the election to President Bush who then proceeded to become the worst President we will ever see in our lifetimes. Now, Mr. Romney breaking the law and I seriously doubt that a Republican will charge another Republican (think Mr. Reagan's 11th Commandment--Thou shalt not criticize a fellow Republican) for violating the law. This all very dangerous precedent. We should be hankful that President Obama does not lower himself to the same level. If he did, through the DOJ and IRS, then it would be quite interesting to see the string of Indictments that would inevitably result. I honestly think this was an honest mistake, that if one knew the area they would understand. I however know the area extremely well, and that cousin's subs location is the closest restaurant to my house. One thing that absolutely nobody has mentioned, is the fact that the restaurant's location, is literally right across the side street, from the local republican headquarters. As an added bonus, there is a very discreet(I didn't even know it was a porn shop until a school bus driver told me) porn shop on the other side of the highway.

I rather regret not taking advantage of it and getting some free subs (I love cousin's subs)... However I have no intention of voting, there's no republican or democratic candidate that's worth voting for, no lesser of evils. All the worst laws that have entered congress during the Obama administration have had full bipartisan support.

1) For a Presidential candidate NOT to know that electioneering is illegal is a bad sign of his grasp on the law. I know, he's a business man, but he wants to LEAD the country. He should know the basics.
2) Did the NRC pay the shop for the food? Or is it an unclaimed donation? Who is paying for this... taxpayers? Doesn't the act bring into question some of the campaing laws?

How pathetic they are.....to think that a sub sandwich is a bribe to vote for anything. You must have very little faith in the American public. Even a kid would not make a promise for a silly subway sandwich. Are you f--king kidding me? This is the same state that had 29 supposedly impartial judges sign petitions to try and recall the governor. The GAB is the same board that is allowing recall petitions with names like Mickey Mouse and Adolph Hitler. And oh by the way lets not forget a pres.that sold his soul to the likes of Solyndra and George Soros.
I wonder if the dem. party uses the same editors as NBC? We all know how much we can believe them.

I suppose that every elected official should fall into the same category as bribing people to get something like a vote. Consider the fact that all politicians who have accepted money during campaigning have taken money on the premise to get a politician into office for the sole purpose of obtaining a sympathetic vote or gift in the form of budget funding for their pet project or a sympathetic view of their personal cause, or obtaining an amendment to the tax codes in an effort to not pay taxes at """""THEIR FAIR SHARE""""". They are all less than morally right. What else is new. Get real folks, a dollar sandwich for my vote, it would take more than that,,,,,,,,maybe a bag of chips and a soda.....see the ridiculous ironey of this garbage. Cousins has ran promo's like this in the past, they just didn't have candidates doing the serving. Regardless of what the DA decides, I doubt there will be anything to come of it.

I think you are all missing out on an important precedent. Christ, before he began the Sermon on the Mount, "passed out sandwiches," or fish and chips or something. These guys were just recognizing the fact that the potential voters might be hungry, and, if hungry, would be distracted by that.

On a more macroscopic level, the Presidency IS for sale. There are no more Abe Lincolns getting this job folks. The line up is millionaires and probably billionaires. The leading candidates in either party are the ones who spend the most...who outspend all the others combined. So to chastise a guy for buying a handful of people a sub sandwich is ludicrous, when its fine for the job itself to list out at tens of millions. How about buying attack ads and running them non-stop?

This is just SO typical of the Republican attitude towards laws and restrictions in general: "If you're wealthy enough, nothing applies to you." Is this a big deal? Just a submarine sandwich? Yes, it IS a big deal-- because the law forbids the provision of ANY item valued at more than a dollar! Period. It doesn't say "except for submarine sandwiches"-- it says ANY item. As soon as you make ANY exception, the slow creep begins. Well, can we give "fries" away, too? How about a milkshake? How about a $5 bill? $50? $500?

A bribe is a bribe is a bribe. Romney (and RYan, too) BOTH need to have their noses rubbed in this, but good! If the election commission fails to do so, then we might just as well fold up the whole tent of the "American experiment" with democracy, because it will have failed-- completely!

Who cares if it is illegal or not? The important thing is I missed out on a free sandwich because I live in the wrong state! All I got was a pitiful "I Voted" sticker which contains close to zero calories. Now with a sub sandwich, I could subsist for one or two more days!
